SparkColors Terms of Service

1. Acceptance of These Terms

These Terms of Service (the “Terms”) govern your access to and use of the SparkColors browser extension, website, account services, community features, AI-assisted tools, paid features, and related services (collectively, the “Service”). SparkColors is an independently developed service. In these Terms, “SparkColors,” “we,” “us,” and “our” refer to the operator of SparkColors.

By creating an account, signing in, accessing or using the Service, purchasing a paid feature, or otherwise indicating acceptance, you agree to these Terms and acknowledge the SparkColors **Privacy Policy**. If you do not agree, do not access or use the Service.

Additional terms may apply to a particular feature or transaction, including the Refund Policy, rules displayed in the product, community guidelines, third-party provider terms, and the Creem Buyer Terms for purchases processed by Creem. If additional terms conflict with these Terms, the more specific terms control for the relevant feature or transaction, except that applicable law and Creem’s Buyer Terms control where they are required to do so.

2. Eligibility

You must be at least 16 years old and old enough under the laws of your location to enter into a binding agreement. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf and supervise your use of the Service.

The Service is not intended for children under 16. You may not use the Service if applicable law prohibits you from receiving or using it.

If you use the Service for a company, school, organization, or other entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” includes both you and that entity.

3. Service Description

SparkColors is a web-reading and knowledge-organization service. Depending on your browser, account, plan, location, and current product version, the Service may include:

• browser extensions for Chrome, Edge, Firefox, and other supported browsers;
• webpage highlighting, annotation, thoughts, casual notes, source references, and reading-position features;
• popup, side-panel, and webpage interfaces;
• synchronization, search, import, export, and knowledge-graph features;
• public and private content, profiles, feeds, reactions, bookmarks, reports, and community features;
• AI-assisted reading, summaries, key points, questions, explanations, translation, entity extraction, conflict analysis, and chat;
• memberships, usage allowances, rewards, energy, achievements, themes, and visual effects; and
• websites, backend APIs, account management, and support services.

Features may differ between browsers and may require particular browser permissions, an account, an active membership, a supported language, or access to a third-party provider. We do not promise that every feature will be available in every browser, location, language, or plan.

4. Accounts, Authentication, and Security

You may create or access an account using a supported email and password flow or a supported third-party identity provider, such as Google or GitHub. When you use a third-party identity provider, its terms and privacy policy also apply to its services.

You agree to provide accurate information, keep it reasonably current, and maintain only accounts you are authorized to use. You must not impersonate another person, create accounts in bulk, transfer or sell an account, share access in a way that defeats plan or security restrictions, or use another person’s credentials without permission.

You are responsible for protecting your email account, password, connected identity-provider accounts, devices, sessions, recovery methods, and any third-party API credentials connected to SparkColors. You are responsible for activity performed through your account unless caused by a failure for which SparkColors is legally responsible.

Notify us promptly at hi@sparkcolors.com if you believe your account, session, or credentials have been compromised. We may revoke sessions, require reauthentication, temporarily restrict access, or take other reasonable protective action when we detect a security risk.

5. Browser Extension and Permissions

To provide its user-facing functions, the extension may request browser capabilities such as storage, identity, activeTab, tabs, website access, sidePanel, downloads, and clipboardWrite. Permissions vary by browser and version.

These permissions may be used to identify and interact with the active webpage, display the SparkColors interface, restore annotations, save local preferences, support authentication, process content you select or ask SparkColors to analyze, create a user-initiated visual capture, copy content after your action, or save an export you request.

A browser permission provides a technical capability; it does not mean that all information accessible through that permission is collected or transmitted. For example, clipboardWrite allows SparkColors to write content after a user action and does not allow SparkColors to read your clipboard.

You may restrict site access or disable SparkColors on selected sites through supported browser or product settings. Some features will not work if a necessary permission is denied. Our processing of information accessed through browser permissions is described in the Privacy Policy.

6. Acceptable Use

You may use the Service only in compliance with these Terms and applicable law. You must not, and must not help another person to:

• use the Service for unlawful, fraudulent, deceptive, abusive, or harmful activity;
• infringe or misappropriate copyrights, trademarks, privacy rights, contractual rights, database rights, or other rights;
• upload, publish, or transmit malware, malicious code, destructive instructions, or content designed to compromise a device, account, network, or service;
• probe, scan, attack, overload, disrupt, or bypass the security, authentication, rate limits, quotas, moderation, or access controls of the Service;
• gain unauthorized access to accounts, systems, data, prompts, models, providers, or non-public features;
• use bots, scripts, scraping, bulk registration, automated requests, or shared accounts in a manner that creates unreasonable load, circumvents limits, or is not expressly authorized by SparkColors;
• reverse engineer, decompile, disassemble, or attempt to derive source code or non-public models from the Service, except to the limited extent applicable law expressly permits and does not allow that restriction to be waived;
• resell, sublicense, rent, commercially exploit, or provide the Service to third parties as a competing or hosted service without our written permission;
• use the Service to generate, store, or distribute spam, harassment, threats, hate, sexual exploitation, unlawful violence, deceptive impersonation, or other prohibited content;
• manipulate rewards, energy, usage records, memberships, referrals, reports, votes, or community visibility;
• submit false reports, payment disputes, refund information, identity information, or support claims; or
• use third-party webpage content in a way that violates the webpage owner’s terms, intellectual-property rights, access restrictions, or applicable law.

Reasonable personal automation that does not bypass limits, harm the Service, or violate applicable rules may be permitted only where the product expressly supports it. Contact us before using unlisted automated access.

7. User Content and Licenses

“User Content” means annotations, selected text, thoughts, notes, comments, prompts, files, images, captures, profile information, feedback, community posts, reports, and other content you submit, create, import, synchronize, or publish through the Service.

As between you and SparkColors, you retain your ownership rights in your original User Content. You are responsible for your User Content and represent that:

• you own it or have all permissions needed to submit and use it through the Service;
• its submission and use do not violate law, third-party rights, confidentiality obligations, or contractual restrictions; and
• it does not contain information that you are prohibited from providing to SparkColors or the applicable service provider.

You grant SparkColors a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, format, technically adapt, display, publish, distribute, moderate, and otherwise process User Content only as reasonably necessary to operate, secure, provide, support, and improve the Service; comply with your visibility choices; make requested exports; prevent abuse; and comply with law. This license includes the right to use service providers as subprocessors and, for content you make public, to enable other users to view, interact with, link to, and share it through supported features.

This license ends when the relevant User Content is deleted from active systems, except to the extent continued processing is reasonably necessary for backups, security, legal compliance, dispute resolution, content previously shared or copied by others, or other purposes described in the Privacy Policy. SparkColors does not receive ownership of your User Content through this license.

The license above does not authorize SparkColors to train AI models operated by SparkColors on your User Content without an additional lawful basis or permission. Third-party AI providers may process submitted content under their own terms, contracts, and settings as explained below and in the Privacy Policy.

If you submit product feedback, suggestions, or ideas, you grant SparkColors a perpetual, worldwide, non-exclusive, royalty-free right to use and incorporate that feedback without restriction or compensation, provided we do not publicly identify you as its source without permission.

8. Public, Anonymous, and Community Content

You control whether content is private, public, or anonymously displayed where the product provides those choices. Verify the selected visibility before submitting content.

Public content may be visible to anyone and may be indexed, quoted, copied, linked, translated, analyzed, reshared, or retained by other people or services outside SparkColors’ control. Changing or deleting content from SparkColors may not remove copies already made by others.

If you select an anonymous display option, SparkColors hides the public profile identity as described in the interface. The content may remain associated with your account internally for operation, moderation, security, abuse prevention, report handling, and legal compliance. Anonymous display is not technical anonymity from SparkColors, its authorized service providers, or authorities acting through valid legal process.

Community content represents the views of its authors, not SparkColors. We do not endorse or guarantee community content and are not responsible for actions you take in reliance on it.

9. Content Moderation, Reports, and Appeals

We may use user reports, automated signals, technical filters, and human review to detect violations of these Terms, community rules, or law. Automated systems can make mistakes and may be supplemented or reviewed by authorized personnel where appropriate.

We may refuse publication; attach warnings; limit reach or functionality; remove, hide, or de-index content; revoke public visibility; restrict interactions; freeze rewards; or suspend or terminate accounts when reasonably necessary to:

• enforce these Terms or published community rules;
• address illegal, infringing, harmful, deceptive, or abusive content or conduct;
• protect users, third parties, SparkColors, or the integrity of the Service;
• respond to a valid report, court order, or legal obligation; or
• investigate fraud, security incidents, or coordinated manipulation.

Where reasonably practical and legally required, we will provide notice of a material moderation action and a meaningful reason, unless doing so could create a security risk, facilitate abuse, violate law, or compromise an investigation.

You may request review of a moderation or account action by emailing hi@sparkcolors.com with the relevant account, content, or decision information. Appeals must be made in good faith. We may uphold, modify, or reverse a decision after review. Nothing in this section limits any external complaint or redress right available under applicable law.

10. AI, Translation, and Automated Features

AI-assisted and translation features may process prompts, selected or relevant webpage content, annotations, source information, conversation history, and other context needed to provide the result. Processing may be performed by SparkColors systems and by AI or translation providers selected by SparkColors or configured by you.

If you connect your own provider credential, you authorize SparkColors to use it to make the requests you initiate. You are responsible for the provider account, applicable charges, permissions, limits, and compliance with that provider’s terms. Do not share a credential you are not authorized to use.

AI output may be incomplete, inaccurate, offensive, outdated, or unsuitable. It may not be unique, and another user may receive similar output. You must review output before relying on, publishing, or acting on it. AI output is not legal, medical, financial, investment, tax, or other professional advice and does not represent SparkColors’ official views.

Subject to applicable law and third-party provider terms, SparkColors does not claim ownership of output generated specifically in response to your request. We do not guarantee that any output is copyrightable, non-infringing, exclusive, or available for a particular commercial use.

Do not submit passwords, payment credentials, government identifiers, medical information, confidential work information, or other highly sensitive data unless you have determined that the processing is lawful and appropriate.

AI, translation, and other cost-bearing features may be subject to free allowances, membership entitlements, model availability, technical limits, rate limits, fair-use controls, safety measures, and anti-abuse review. A feature described as “unlimited” means that it does not have the stated ordinary daily quota during the applicable plan period; it does not permit attacks, automated bulk usage, account sharing, resale, unreasonable load, or circumvention of technical or safety controls.

11. SparkColors Intellectual Property

The Service, including its software, interfaces, design, branding, documentation, graphics, original content, and underlying technology, is owned by SparkColors or its licensors and is protected by applicable intellectual-property laws. User Content and third-party webpage content remain subject to their respective owners’ rights.

Subject to these Terms, SparkColors grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the extension and access the Service for its intended personal or internal business purposes during the term of these Terms.

This license does not give you ownership of the Service or permission to use SparkColors names, logos, trademarks, or branding except as needed to identify the Service. Open-source components are governed by their applicable licenses.

12. Free Features, Usage Allowances, and Gamification

SparkColors may provide free features and per-tool daily allowances. At the time of this version, webpage annotation is a baseline free capability, while translation, AI answers, and reading-assistant features may have separate free allowances because they rely on cost-bearing third-party services.

Free offerings, limits, and feature availability may change prospectively. We will not retroactively reduce an active paid entitlement without providing any notice or remedy required by applicable law.

Energy balances, bills, rewards, streaks, levels, achievements, themes, skins, effects, and similar features are product-experience or promotional mechanisms. Unless SparkColors expressly states otherwise in writing, they are not money, stored value, securities, cryptocurrency, transferable property, or redeemable for cash.

We may correct errors and adjust, reverse, freeze, or revoke energy, rewards, achievements, or unlocks obtained through error, fraud, abuse, manipulation, or violation of these Terms. We will act reasonably and will not use this section to remove purchased membership rights arbitrarily.

13. Prepaid Pro Membership

SparkColors may offer fixed-duration Pro access. Current plans may include 30-day and 365-day prepaid periods. The plans, prices, currencies, features, and durations displayed at checkout at the time of purchase form part of your purchase terms.

Pro access is prepaid and does not automatically renew unless the checkout clearly states otherwise and obtains any consent required by law. Under the current model, access expires automatically at the end of the purchased period, and no further payment is charged unless you make another purchase.

If you purchase another eligible prepaid period while Pro is active, the additional period normally begins after the existing eligible period ends. Account status, refunds, chargebacks, promotional grants, corrections, and other conditions may affect the calculated end date.

Paid benefits apply only to the account associated with the purchase and may not be transferred, resold, shared, converted to cash, or used to operate a service for others. Membership obtained through a redeem code, gift, campaign, administrator grant, or other non-paid source is not refundable, cashable, or transferable unless specific written rules state otherwise.

We may enforce reasonable technical, security, fair-use, and anti-abuse controls for all plans, including Pro. These controls do not convert the current prepaid product into an automatically renewing subscription.

14. Creem Checkout, Payment, and Taxes

Paid purchases are processed through Creem, which acts as the merchant of record and contractual reseller for the purchase transaction. Creem processes payment, issues the invoice, and calculates and handles applicable indirect taxes based on the information provided at checkout. SparkColors remains responsible for delivering and supporting the SparkColors product.

By completing a Creem checkout, you also agree to the applicable **Creem Buyer Terms** and checkout disclosures. Creem’s Buyer Terms govern the purchase transaction between you and Creem. These Terms govern your use of SparkColors and provide product-specific conditions.

The total price, currency, applicable taxes, payment method, and other transaction details are displayed before you complete checkout. You authorize Creem to charge the displayed amount to the payment method you provide. You must provide accurate billing and tax information.

SparkColors activates Pro only after receiving reliable payment confirmation through the payment-provider flow. A redirect page, screenshot, pending authorization, or client-side message alone does not prove successful payment. Activation may be delayed while payment confirmation, fraud review, or technical synchronization is pending.

15. Refunds, Withdrawal Rights, and Payment Disputes

The SparkColors **Refund Policy** forms part of these Terms for paid SparkColors products. The commercial refund policy currently allows a user to submit a request for manual review when:

• the request is submitted within seven calendar days after payment is confirmed;
• the order has no more than 20 qualifying paid-feature usage events recorded after purchase;
• the request is for a full refund; and
• the order is otherwise eligible and is not associated with fraud, abuse, policy evasion, or another disqualifying condition.

Submitting a request does not guarantee approval. Partial refunds are not offered under this commercial policy. If approved, the refund must still be completed by Creem through the applicable payment method. Timing after approval depends on Creem, the payment network, the payment method, and the recipient institution.

The corresponding membership grant ends when the refund is confirmed as completed, unless the account has another valid membership grant. We may revoke access earlier where required to prevent fraud or comply with Creem instructions or applicable law.

The seven-day commercial policy does not replace, restrict, or waive any non-waivable right, remedy, guarantee, cancellation right, or withdrawal right you have under applicable consumer law or the Creem Buyer Terms. If applicable law provides a longer period or additional remedy, that law controls.

For example, consumers in certain jurisdictions may have statutory rights concerning digital services, including rights relating to non-conforming services or a withdrawal period. Where permitted by law, checkout may request your express consent to begin providing digital access immediately and your acknowledgement of how immediate performance affects a statutory withdrawal right.

If you believe a payment is incorrect or a paid feature was not delivered, contact hi@sparkcolors.com or use the official refund flow first so we can investigate. Refunds and chargebacks for Creem transactions are processed through Creem. We may provide Creem or the payment network with relevant transaction, delivery, usage, communication, and fraud-prevention records when responding to a dispute. This does not limit your right to make a good-faith payment dispute where permitted by law.

16. Third-Party Services and Content

The Service depends on or interacts with third parties, which may include browser stores and browsers, Google, GitHub, Creem, Resend, DeepL, AI providers, hosting providers, websites you visit, and providers configured by you.

Third-party services and content are governed by their own terms, policies, availability, and technical decisions. SparkColors does not control third-party webpages, models, outputs, browser policies, payment networks, or provider accounts. We are not responsible for third-party acts or omissions except to the extent applicable law makes us responsible or the issue results from our own breach.

You are responsible for determining whether you may lawfully annotate, capture, import, quote, translate, analyze, export, or publish third-party webpage content. SparkColors providing a technical feature does not grant you rights in third-party content.

17. Privacy and Data

The SparkColors Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Service, you acknowledge that processing described in the Privacy Policy may be necessary to provide requested features.

You should maintain your own backup of important User Content. Although SparkColors may provide synchronization, export, recovery, or backup features, we do not guarantee that every item can always be recovered. Data export and deletion options may be limited by technical constraints, third-party copies, legal retention, and the rules described in the Privacy Policy.

You may request account deletion. Under the current process, the account enters a 15-day pending-deletion period during which you may cancel the request by completing the supported recovery flow. After that period, SparkColors begins deleting or de-identifying account data, subject to permitted retention for payments, taxes, security, fraud prevention, moderation, legal claims, backups, and other purposes described in the Privacy Policy.

18. Service Changes, Availability, and Discontinuation

We may add, change, limit, suspend, or discontinue features to improve the Service, address security or legal requirements, respond to browser or provider changes, manage costs, or evolve the product.

We do not guarantee uninterrupted or error-free availability. The Service may be unavailable because of maintenance, upgrades, outages, network conditions, third-party failures, browser-policy changes, security events, force majeure, or circumstances outside our reasonable control.

For material changes that adversely affect an active paid entitlement, we will provide reasonable notice where practical and any remedy required by applicable law. Depending on the circumstances, an appropriate remedy may include restoring service, providing an alternative, extending access, or issuing a proportionate refund through the payment provider.

19. Suspension and Termination

You may stop using the Service at any time. Uninstalling the extension does not automatically delete your account or synchronized data. Use the supported account-deletion process if you want to request account deletion.

We may restrict, suspend, or terminate content, features, sessions, or accounts when reasonably necessary because of:

• a material or repeated violation of these Terms or applicable feature rules;
• fraud, chargeback abuse, account sharing, quota circumvention, or payment risk;
• illegal, infringing, harmful, or abusive content or conduct;
• a security threat or unauthorized access;
• a valid legal requirement or third-party platform requirement;
• non-payment or reversal of a paid transaction; or
• discontinuation of the Service.

Where the issue is not urgent, we may provide notice and an opportunity to correct it. We may act immediately where delay could cause harm, enable abuse, compromise security, or violate law. You may appeal as described in Section 9.

Termination ends your license to use the Service. Provisions that by their nature should survive—including ownership, payment records, completed licenses, disclaimers, liability limitations, dispute provisions, and legal-retention rights—remain effective.

If we terminate paid access because of your material violation, you are not entitled to a refund under the commercial Refund Policy, except where applicable law requires otherwise. If we discontinue a paid feature for reasons unrelated to your conduct, Section 18 applies.

20. Disclaimers

Nothing in these Terms excludes warranties, guarantees, remedies, or responsibilities that cannot lawfully be excluded.

Subject to that rule, the Service is provided on an “as available” basis. We do not promise that every feature will always be available, uninterrupted, secure
